Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the AIPoweredTesting desktop application, the website at ai-powered-testing.com, and any related services (collectively, the "Service"). The Service is operated by Aleksandr Koshcheev, a Mexican sole proprietor (Persona Física en Régimen Simplificado de Confianza) described in "Legal entity" below ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Introduction

AIPoweredTesting is currently in closed beta. The Service is offered on an invite-only basis to a limited audience while we refine functionality and collect feedback. These Terms apply to all users of the closed beta and will continue to apply when paid subscriptions open. We may revise these Terms as described in "Changes to these Terms" below.

2. Definitions

• User — any individual who accesses the Service.
• Beta Code — a one-time activation code issued by us to grant access to the closed beta.
• Subscription — any future paid plan offered once paid billing opens.
• Content — any test scripts, scenarios, screenshots, feedback, or other data you create or upload through the Service.
• Effective Date — the date indicated at the top of this document.

3. Service description

AIPoweredTesting is an AI-powered automated UI testing platform for iOS and Android mobile applications. The desktop client orchestrates iOS Simulators via Xcode and Android Emulators via Android Studio, records and plays back test scenarios, and shares sessions, presets, and reports across your team. Because the Service is in closed beta, we provide it on a best-effort basis with no service-level agreement (SLA). Features and functionality may change materially between releases.

4. Account registration

To use the Service you must sign in with a Google account. One account is intended for one natural person — sharing account credentials is not permitted. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account. Notify us promptly at support@ai-powered-testing.com if you suspect unauthorized access. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to register an account.

5. Beta access

Access to the closed beta is granted by invitation via a one-time Beta Code delivered to your email. Each Beta Code is valid for 14 calendar days from the date of issuance; if not redeemed within that window, it expires automatically. A successfully redeemed Beta Code grants you access to the beta tier of the CORE plan for 30 calendar days. At our sole discretion we may extend, shorten, pause, or revoke beta access at any time, for any reason, including but not limited to suspected violation of these Terms.

6. Payment

During the closed beta, no payment is required. Terms for paid subscriptions will be published before the first invoice is issued. When paid plans open, the Service will be offered at US$30 per seat per month, all taxes included, billed monthly. We will provide written notice of the start of paid billing and the relevant updated Terms at least 30 days in advance.

7. Acceptable use

You agree not to:

• reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service (except to the extent that such restriction is prohibited by applicable law);
• scrape, crawl, or otherwise programmatically access the Service in a manner that could reasonably degrade its performance for other users;
• share, transfer, sell, or otherwise distribute your Beta Code or account credentials;
• use the Service to test applications that you do not own or are not authorized to test;
• use the Service for any unlawful purpose or in violation of any applicable law.

8. Intellectual property

All rights, title, and interest in and to the Service — including all underlying software, documentation, trade marks, and the AIPoweredTesting brand — are and shall remain the exclusive property of the legal entity described below. You retain all rights to Content you create; you grant us a limited, non-exclusive license to process that Content solely as necessary to provide the Service to you.

9. Warranty disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities, nor do we warrant that any defects will be corrected.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) US$100. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service in violation of these Terms, (b) your Content, or (c) your violation of any applicable law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access — with or without notice — if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the closed beta. Upon termination, sections 8 (Intellectual property), 9 (Warranty disclaimer), 10 (Limitation of liability), 11 (Indemnification), 14 (Governing law and dispute resolution), and any other provisions that by their nature should survive, will survive.

13. Changes to these Terms

We may update these Terms from time to time. The current version is always available at ai-powered-testing.com/legal/terms. Material changes will be communicated by email to the account address associated with your access and/or by a banner on the Service at least 30 days before they take effect. Continued use of the Service after the effective date of the change constitutes your acceptance of the updated Terms.

14. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the State of Jalisco, México, without regard to its conflict-of-laws principles. The parties agree to the exclusive jurisdiction of the competent courts of Zapopan, Jalisco, México for any dispute arising out of or relating to these Terms, subject to any non-waivable consumer- protection rights you may have under the laws of your country of residence, including PROFECO rights for Mexican consumers.

15. Language

These Terms are drafted in English. AIPoweredTesting may provide translations of these Terms into other languages (including Spanish for the Mexican market) solely for your convenience. In the event of any inconsistency or conflict between the English version and any translation, the English version shall prevail and be legally binding, except where mandatory local law requires otherwise. A Spanish version for Mexican consumers will be made available no later than the start of paid billing; where mandatory Mexican consumer law (Ley Federal de Protección al Consumidor) requires the Spanish text to govern, it will govern the consumer-rights aspects of these Terms.
