Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the AIPoweredTesting desktop application, the website at ai-powered-testing.com, and any related services (collectively, the "Service"). The Service is operated by Aleksandr Koshcheev, a sole proprietor registered in Mexico (Persona Física en Régimen Simplificado de Confianza) described in "Operator and contact" below ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

1. Introduction

The Service is available to anyone who downloads the AIPoweredTesting desktop application and signs in. Team features — sync, sharing, and team access — are available during a free Trial and with a paid Subscription; without either, the application works in free local mode (sections 5 and 6). These Terms apply to all users of the Service. We may revise these Terms as described in "Changes to these Terms" below.

2. Definitions

• User — any individual who accesses the Service.
• Organization — a team workspace in the Service, created by one User (its owner), to which Trials, Subscriptions, and Seats belong.
• Seat — one member of an Organization with access to team features. The Organization's owner always occupies one Seat.
• Trial — a free 30-day period with sync and team features for up to 3 Seats. No payment method is required, and each Organization can use one Trial.
• Subscription — a paid CORE plan, billed monthly per Seat.
• Free local mode — use of the application without a Subscription or an active Trial: it works on your Mac, without sync and team features.
• Content — any test scripts, scenarios, screenshots, feedback, or other data you create or upload through the Service.
• Effective Date — the date indicated at the top of this document.

3. Service description

AIPoweredTesting is an AI-powered automated UI testing platform for iOS and Android mobile applications. The desktop client orchestrates iOS Simulators via Xcode and Android Emulators via Android Studio, lets you compose and run test scenarios from reusable steps, and shares sessions, presets, and reports across your team. We provide the Service on a best-effort basis with no service-level agreement (SLA). Features and functionality may change materially between releases.

4. Account registration

To use the Service, you must sign in with a Google or Apple account. One account is intended for one natural person — sharing account credentials is not permitted. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account. Notify us promptly at support@ai-powered-testing.com if you suspect unauthorized access. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to register an account.

5. Free trial and free local mode

An Organization can start a free Trial: 30 calendar days of sync and team features for up to 3 Seats. No payment method is required to start a Trial, and each Organization can use only one Trial. When the Trial ends, you can buy a Subscription (section 6) or continue in free local mode: the application keeps working on your Mac, while sync, sharing, and team access stop. In free local mode your data stays on your Mac and is not backed up by us; signing out of the application permanently deletes it. If you later buy a Subscription, the work you did in free local mode is uploaded and synced.

We may change the Trial terms for Organizations that start a Trial after the change; we will announce any such change on our website. A Trial that has already started keeps the terms it started with.

6. Subscriptions, billing and payment

Paid use of the Service is sold as a Subscription for an Organization. The following applies to every Subscription:

• Who manages it. Only the Organization's owner can subscribe, change Seats, or cancel.
• Price. The price in effect at the time of purchase is shown on the Pricing page and at checkout. As of the effective date of these Terms: US$30 per Seat per month (taxes included); for customers in Mexico, MX$549 per Seat per month (16% IVA included); for business customers in the European Union, €29 per Seat per month (VAT not included — reverse charge applies; a valid VAT ID is required at checkout). You choose the billing currency before your first payment; it then applies to the whole Subscription. If your card is in another currency, your card issuer converts the amount at its own rate and may charge a fee.
• EU customers. In the European Union we sell to businesses only. By purchasing from an EU country you confirm that you are acting as a business and that the VAT ID you provide is valid.
• Billing and renewal. Subscriptions are billed monthly in advance and renew automatically on the monthly anniversary of your first payment until cancelled. We email you a reminder at least 5 days before each renewal; if you cancel before the renewal date, you are not charged again.
• Payment processor. Payments are processed by Stripe. Your card details are collected and stored by Stripe; we never see or store your full card number.
• Seats. A Seat added during a billing period gets access immediately; the prorated charge for the rest of that period is added to your next invoice. Removing a Seat takes effect immediately and does not give a refund for the rest of the current period; the following invoice reflects the lower number of Seats.
• Failed payments. If a payment fails, Stripe retries the charge over the following days and we notify you by email. Your access continues while the charge is being retried. If the payment still cannot be collected, the Subscription ends, access to paid features stops, and the Organization moves to free local mode.
• Cancellation. You can cancel at any time in the application (Organization Settings → Subscription → Cancel subscription, or Manage billing, which opens the Stripe Customer Portal) or by emailing support@ai-powered-testing.com. After cancellation you keep access to paid features until the end of the billing period you have already paid for, and no further charges are made. Cancelling is not a refund. Until the paid period ends, you can resume the Subscription in Manage billing.
• Deleting an Organization. An Organization with a Subscription can be deleted only after the Subscription has been cancelled and the paid period has ended.
• CFDI (Mexico). Customers in Mexico can request a CFDI by emailing support@ai-powered-testing.com with the details from their Constancia de Situación Fiscal (RFC, name or business name, tax regime, and postal code) and their uso de CFDI. Please send the request within the calendar month of the payment, so that the CFDI can be issued for that month.
• Refunds. Refunds are governed by our Refund Policy.
• Price changes. We may change the price with at least 30 days' notice by email. A new price applies from the first billing period that starts after the notice period.

7. Acceptable use

You agree not to:

• reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service (except to the extent that such restriction is prohibited by applicable law);
• scrape, crawl, or otherwise programmatically access the Service in a manner that could reasonably degrade its performance for other users;
• share, transfer, sell, or otherwise distribute your account credentials or your Seat;
• use the Service to test applications that you do not own or are not authorized to test;
• use the Service for any unlawful purpose or in violation of any applicable law.

8. Intellectual property

All right, title, and interest in and to the Service — including all underlying software, documentation, trademarks, and the AIPoweredTesting brand — are and shall remain the exclusive property of the operator identified in section 16. You retain all rights to Content you create; you grant us a limited, non-exclusive license to process that Content solely as necessary to provide the Service to you. If you voluntarily send us feedback or suggestions, we may use them to improve the Service without obligation or compensation to you.

9. Warranty disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities, nor do we warrant that any defects will be corrected.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) US$100. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service in violation of these Terms, (b) your Content, or (c) your violation of any applicable law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access — with or without notice — if we reasonably believe you have violated these Terms or if required by law. A Subscription also ends for non-payment as described in section 6. Upon termination, sections 8 (Intellectual property), 9 (Warranty disclaimer), 10 (Limitation of liability), 11 (Indemnification), 14 (Governing law and dispute resolution), and any other provisions that by their nature should survive will survive termination.

13. Changes to these Terms

We may update these Terms from time to time. The current version is always available at ai-powered-testing.com/legal/terms. Material changes will be communicated by email to the email address associated with your account and/or by a banner on the Service at least 30 days before they take effect. Continued use of the Service after the effective date of the change constitutes your acceptance of the updated Terms. If you do not agree, you can cancel before the change takes effect and you will not be charged under the changed terms.

14. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the federal laws of Mexico and, where applicable, the laws of the State of Jalisco, without regard to conflict-of-laws principles. The parties agree to the exclusive jurisdiction of the competent courts of Zapopan, Jalisco, Mexico for any dispute arising out of or relating to these Terms, subject to any non-waivable consumer-protection rights you may have under the laws of your country of residence, including PROFECO rights for Mexican consumers.

15. Language

These Terms are drafted in English. We may provide translations of these Terms into other languages (including Spanish for the Mexican market) solely for your convenience. In the event of any inconsistency or conflict between the English version and any translation, the English version shall prevail and be legally binding, except where mandatory local law requires otherwise. A Spanish-language version of these Terms and of the Refund Policy is available at ai-powered-testing.com/es/legal/terms and ai-powered-testing.com/es/legal/refund. For consumers in Mexico, the Spanish version is the binding version (Article 85 of the Ley Federal de Protección al Consumidor, LFPC); in all other cases the English version prevails.
